Terms and Conditions – Baltimore Children & Youth Fund

Welcome to Baltimore Children & Youth Fund’s Course Terms and Conditions. These Terms and Conditions (“Terms”) govern your purchase, access, and participation in courses provided by Baltimore Children & Youth Fund (“BCYF”, “we,” “us,” or “our”). Please read these Terms carefully before purchasing any course. By purchasing, registering, or accessing our courses, you (“user”) agree to these Terms.

1. Eligibility

1.1. You must be at least 18 years old to register, purchase, or enroll in any of our courses. If you are not 18 years or older, the course must be acknowledged, registered, and purchased by an authorized adult.

1.2. If purchasing on behalf of an organization or another individual, you confirm that you have the authority to bind them to these Terms.

2. Course Registration, Purchase, and Payment

2.1. All course prices are listed on our website and are subject to change without notice.

2.2. Payment is required in full at the time of purchase. Accepted payment methods include credit card only.

2.3. We reserve the right to refuse or cancel your order if payment is not received or if unauthorized payment is detected.

2.4. Any credit card cancellations or other payment issues after purchase are subject to an additional fee.

3. Registration and Access to Courses

3.1. Upon successful registration and/or payment, you will receive access to the purchased course for the duration specified on the course page.

3.2. Access credentials (such as passwords) are personal and must not be shared with third parties. Any misuse may result in account suspension or termination.

3.3. We are not responsible for any interruptions in access due to factors beyond our control, such as internet outages or technical issues.

4. Refund and Cancellation Policy

4.1. Refunds will only be provided under the conditions specified on the course page or during the checkout process.

4.2. Refund requests must be submitted within 14 days of purchase.

4.3. No refunds will be granted if the course has been accessed or completed beyond a specified threshold (e.g., 20% of the course content).

4.4. If BCYF cancels a course, you will be entitled to a full refund or enrollment in another course of equal value – the final decision is up to BCYF.

4.5. BCYF is committed to providing every user with an exceptional experience. Should that not be the case, BCYF reserves the right to use discretion on how to handle such a situation, as it arises.

5. Copyright and Intellectual Property

5.1. All course content, including text, videos, audio, graphics, and other materials, is the intellectual property of BCYF and is protected by copyright laws.

5.2. You may not reproduce, distribute, modify, or create derivative works from the content without prior written permission from BCYF.

5.3 You may not delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from this course.

5.4. Unauthorized sharing or distribution of course materials may result in account termination and legal action. Refunds will not be given should your account be terminated in such circumstances. Users are responsible for legal fees should legal action be necessary.

5.5 If you print, copy, modify, download, or otherwise use or provide any other person with access to the course in breach of the Terms of Use, your right to use the course will stop immediately and you must return or destroy any copies you have made. No right, title, or interest in the course or any content of the court is transferred to you, and all rights not expressly granted are reserved by the Client. Any use of the course not expressly permitted by the Terms of Use is in breach of the Terms of use and may violate copyright, trademark, and other laws.

6. User Conduct

6.1. You agree to use our courses and platform for lawful purposes only.

6.2. You must not engage in behavior that disrupts the learning environment or compromises the platform's security.

6.3 To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the courses, or which, as determined by us, may harm BCYF, other users, or expose them to liability.

6.4. BCYF reserves the right to suspend or terminate access for users who violate these Terms or engage in harmful conduct. Refunds will not be given should your account be terminated in such circumstances.

7. Course Updates and Modifications

7.1. BCYF reserves the right to update, modify, or discontinue courses at its discretion.

7.2. If a course is significantly modified after your enrollment, we will provide reasonable notice and access to the updated content.

7.3. In the event of course discontinuation, alternative arrangements (such as course credits or refunds) may be provided at BCYF’s discretion.

8. Reliance on Course Information and Disclaimer of Warranties

8.1 The information presented on or through the course content is made available solely for general information purposes. This information is not legal, tax, or other financial advice. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Website, or by anyone who may be informed of any of its contents.

8.2 This course content provided by third parties, including materials provided by other users, bloggers, and third-party licensors, syndicators, aggregators, and/or reporting services. All statements and/or opinions expressed in these materials, and all articles and responses to questions and other content, other than the content provided by the Client, are solely the opinions and the responsibility of the person or entity providing those materials. These materials do not necessarily reflect the opinion of the Client. We are not responsible, or liable to you or any third party, for the content or accuracy of any materials provided by any third parties.

8.3 Your use of the course, its content and any services or items obtained through the course is at your own risk. The course, its content and any services or items obtained through the course are provided “as is” and “as available” basis, without any warranties or any kind, either express or implied, neither BCYF nor any person associated with BCYF makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy or availability of the course. Without limiting the foregoing, neither BCYF nor anyone associated with BCYF represents or warrants that the course, its content, or any services or items obtained through the course will be accurate, reliable, error-free or uninterrupted, that defects will be corrected, that our site or the server that makes it available are free of viruses or other harmful components, or that the course or service or items obtained through the course will meet your needs or expectations.

8.4 To the fullest extent provided by law, BCYF hereby disclaims all warranties of any kind, whether express of implied, statutory, or otherwise, including but not limited to any warranties of merchantability, non-infringement, and fitness for a particular purpose.

9. Limitation of Liability

9.1. BCYF is not liable for any indirect, incidental, or consequential damages resulting from your use of or inability to access our courses.

9.2. Our total liability under these Terms will not exceed the amount paid by you for the relevant course.

9.3. In the event that a BCYF course is given as a gift or purchased by an adult for an individual under age 18, BCYF is not liable for the individual purchasing the course, beyond the purchase of the course. BCYF reserves the right to limit interaction with such individuals to only the purchase of the course.

9.4 The user shall indemnify, defend and hold harmless the BCYF and its affiliates and their respective directors, managers, officers, equity holders, employees, agents, successors and permitted assigns, including the Mayor, City Council and City of Baltimore (collectively, the “Indemnified Parties” and each, an “Indemnified Party”) from and against all losses, liabilities, demands, claims, actions or causes of action, regulatory, legislative or judicial proceedings or investigations, assessments, levies, fines, penalties, damages, costs and expenses (including reasonable attorneys’, accounts’, investigators’ and experts’ fees and expenses) incurred in connection with the defense or investigation of any claim (“Damages”) sustained or incurred by any Indemnified Party arising from or related to illegal activity, intentional misconduct, negligence or breach of these Terms by the Indemnifying Party or any of its employees or contractors.

9.5 The courses offered by BCYF are for educational purposes only and do not constitute legal advice.

10. Privacy Policy

10.1. Your personal information will be kept secure and confidential.

10.2. By purchasing a course, you consent to our collection and processing of your information for the sole purpose of enrollment and participation in BCYF courses.

11. Governing Law and Dispute Resolution

11.1. These Terms shall be governed by and construed in accordance with the laws of the State of Maryland.

11.2. Any disputes arising from or related to these Terms will be subject to the exclusive jurisdiction of the state and federal courts in of Baltimore City, Maryland.

11.3. Any and all legal fees stemming from a legal dispute will be the users responsibility.

12. Changes to Terms and Conditions

12.1. BCYF reserves the right to modify these Terms at any time. Changes will be effective upon posting on our website.

12.2. Continued use of our services after changes are posted constitutes your acceptance of the modified Terms.
